Given this situation of non-compliance with the right to surveillance and the lack of adequate sanctions, DECO calls for the introduction of sanctions that prevent the violation of this right for users of health services and others, and requests the introduction of coordinated systems of safety and risk prevention measures that ensure that users receive care correctly and safely.
Although the law provides for the right to surveillance in health services, it recognizes for all users the right to surveillance by a designated person, and specific rules for pregnant women, children in hospitals, people with disabilities, those in a state of dependency and people suffering from diseases. Incurable, at an advanced stage and at the end of life, cases have been reported proving that this right is not always upheld.
The reporting of these cases also highlighted the absence of uniform safety and monitoring rules that properly protect the provision of care to the most vulnerable users, depending on their health status, especially in cases of addiction.
