Hey On Monday, the President of the Regional Council of the Lisbon Bar Association clarified several issues related to medical leave during the summer or holidays, on the TVI programme “Esta Manhä”.
According to Joao Massano, One of the “most common mistakes” when someone is on vacation and has to take sick leave is “not saying anything to anyone,” i.e. to their employer.
“If a person does not state that he is sick, his leave cannot be suspended. He must notify the employer, because this process is not automatic,” the lawyer pointed out, adding that only after submitting “documents proving the illness is the leave period suspended.”
As João Massano explained, vacations and sick leave are completely different and must be used differently, since “recovering from illness is one thing, recovering from a period of work is another and the person must be perfectly able to take advantage of this well-deserved rest.”
actually Regarding trips to the beach and festivals as well as excursions, the lawyer stated that unless prescribed by a doctor, for example, in the case of mental illness, this cannot happen.
“There are surprise inspections, and inspectors can show up at home. If you don’t want to risk losing your sickness benefit. Caution and chicken broth never hurt anyone,” João Massano finally advised.
